1. Acceptance of These Terms
These Terms of Service ("Terms") are a legal agreement between you and Junior Bay Corporation ("Junior Bay," "we," "us," or "our"). By accessing or using the public Junior Bay poster board at juniorbay.com, including its pages, listing forms, feeds, images, APIs, and related content (collectively, the "Poster Board"), you agree to these Terms.
If you use the Poster Board for a business, organization, employer, or other entity, you represent that you have authority to bind that entity, and "you" includes that entity. If you do not agree to these Terms, do not use the Poster Board.
2. What Junior Bay Provides
Junior Bay is a public poster board where users may submit free posts for things like items for sale, services, jobs, vehicles, spaces, lessons, wanted requests, giveaways, events, and community announcements.
The Poster Board lets people publish, browse, search, and open public posts. It is not a checkout service, escrow service, payment processor, delivery service, employment agency, broker, or managed marketplace. Junior Bay is not a party to any sale, purchase, job, service arrangement, meeting, pickup, delivery, trade, or other interaction between users.
3. Eligibility and Age Requirements
You may use the Poster Board only if you can form a binding contract and comply with these Terms. The Poster Board is intended for users who are at least 13 years old. If you are under 18, you may use the Poster Board only with involvement and permission from a parent or legal guardian.
Junior Bay is not directed to children under 13. Do not submit personal information if you are under 13. If we learn that we have collected personal information from a child under 13 without required parental consent, we may delete that information and restrict the related post or contact information.
4. Email Verification and Review
Posting may require an email address or other basic verification. You agree to provide accurate contact information and keep it current while your post is active.
Submitted posts may be held for email verification, quality review, moderation, fraud checks, category review, or other operational checks before publication. Verification or publication does not mean Junior Bay endorses a post, poster, seller, employer, product, service, claim, announcement, or offer.
5. Posts, Expiration, and User Responses
You are responsible for the accuracy, legality, safety, and completeness of every post you submit. Post details should be truthful, current, and specific enough for other users to evaluate whether they want to respond.
- Sale posts should describe condition, price, availability, and pickup or shipping expectations.
- Service and lesson posts should describe scope, location, availability, rates, and requirements.
- Job posts should describe role, pay or compensation, schedule, location, and applicant requirements.
- Vehicle, space, event, wanted, giveaway, and announcement posts should include material facts that a reasonable user would need before responding.
Unless we state otherwise, approved posts may expire or be removed after 30 days. We may update, re-rank, archive, reject, or remove posts at our discretion.
Users should use care when responding to posts, meeting, buying, selling, hiring, trading, giving away items, or exchanging information. Junior Bay does not control users and does not guarantee identity, ability to pay, product quality, service quality, employment terms, availability, safety, legality, or completion of any user arrangement.
6. User Content and Uploaded Images
"User Content" means posts, text, images, logos, business names, prices, rates, descriptions, files, links, and other materials you submit or upload. You keep ownership of your User Content, subject to the license below.
You grant Junior Bay a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, copy, crop, resize, transform, display, distribute, publish, promote, and otherwise use your User Content for operating, improving, marketing, and protecting the Poster Board. This license continues for as long as needed to operate the Poster Board, maintain backups, comply with law, resolve disputes, and enforce these Terms.
You represent that you have all rights needed to submit your User Content and that it does not infringe, misappropriate, or violate anyone else's rights, including copyright, trademark, privacy, publicity, contract, or other rights.
7. Poster Board Rules and Prohibited Content
You agree not to post, upload, sell, solicit, or promote anything that is unlawful, misleading, harmful, unsafe, infringing, invasive, fraudulent, spammy, or otherwise inappropriate for the Poster Board.
Without limiting the above, you may not use Junior Bay to:
- Post false, deceptive, bait-and-switch, counterfeit, stolen, recalled, unsafe, or unavailable items or offers.
- Offer illegal goods, regulated goods without required permissions, weapons, controlled substances, adult sexual services, exploitative content, or content involving abuse or harassment.
- Violate employment, housing, consumer protection, anti-discrimination, privacy, intellectual property, tax, safety, or advertising laws.
- Collect, publish, sell, or misuse personal information.
- Send spam, unsolicited messages, phishing attempts, malware, or deceptive links.
- Impersonate another person, business, employer, organization, or Junior Bay.
- Interfere with the Poster Board, bypass protections, or abuse reporting, review, or moderation systems.
For user-friendly examples of prohibited categories, see the Prohibited Content list on the About page. That list is not exhaustive, and these Terms control if there is any conflict.
8. Third-Party Links, Feeds, and External Content
Junior Bay may display sample content, partner content, external offers, or posts imported from third-party feeds to help populate the board. Third-party content may include links to websites or services that Junior Bay does not own or control.
Some external links may be affiliate links, and Junior Bay may earn a commission or other benefit if users click, buy, register, or complete another action. Affiliate relationships do not mean Junior Bay manufactures, sells, ships, warranties, or supports the third-party product or service.
Third-party websites have their own terms, policies, prices, availability, shipping, refunds, warranties, and data practices. You are responsible for reviewing those terms before using them.
9. Free Posting
The Poster Board is currently free to post. We may add paid placement, promoted posts, sponsorships, or other optional paid features in the future, but the basic purpose of this front end is free public posting and browsing.
If any fee applies in the future, we will show applicable pricing or payment terms before purchase or submission. We may refuse, remove, or moderate posts even if a fee has been paid, subject to any separate paid-feature terms that apply.
10. Privacy and Communications
Your use of the Poster Board is also subject to our privacy disclosures and any privacy policy we publish. By using the Poster Board, you understand that Junior Bay may process information needed to operate the board, including post details, contact information, uploaded images, usage data, moderation signals, and communications related to verification or support.
By using Junior Bay, submitting a post, or providing your email address, you agree to be subscribed to Junior Bay email notifications. These notifications may include verification messages, post status notices, support responses, policy updates, security alerts, feature announcements, promotional offers, sponsorships, and other marketing content.
You may unsubscribe from marketing emails by using the unsubscribe instructions included in those messages where required by law. Even if you unsubscribe from marketing emails, Junior Bay may still send non-marketing transactional or administrative messages related to your posts, verification, security, legal notices, or support requests. You may not use information obtained through Junior Bay to send spam or unauthorized communications.
11. Limited License, Restrictions, and API Use
If you comply with these Terms, Junior Bay grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Poster Board for its intended public posting and browsing purposes.
You may not copy, frame, scrape, crawl, harvest, index, mirror, sell, resell, reverse engineer, decompile, modify, create derivative works from, or commercially exploit Junior Bay, its posts, code, images, data, API, or user information without our express written permission, except for content you created and own.
You may not use bots, scripts, spiders, scrapers, automated tools, browser automation, data-mining systems, or manual equivalents to collect content or user information, overload the Poster Board, bypass limits, test vulnerabilities without permission, or interfere with normal operation.
12. Moderation and Enforcement
Junior Bay may, at our discretion, review, delay, reject, edit, re-categorize, re-rank, label, hide, remove, archive, preserve, or restore posts. We may also block access, limit posting, require verification, suspend features, or terminate access.
We are not obligated to monitor all content, and we are not liable for moderating or failing to moderate. No action or inaction by Junior Bay waives our rights.
13. Abuse, Liquidated Damages, and Equitable Relief
If you violate these Terms, or encourage, support, benefit from, or induce others to violate them, you may be responsible for losses, investigation costs, enforcement costs, attorneys' fees, statutory damages, and equitable relief.
Because certain abuse is difficult to measure, you agree that the following amounts are reasonable estimates of damages and not penalties where permitted by law:
- Unauthorized collection or harvesting of Junior Bay user information: $1 per affected record or violation.
- Publishing or misusing another person's personal or identifying information without consent: $1,000 per violation.
- Misrepresenting your identity or affiliation in connection with Junior Bay: $1,000 per violation.
- Posting or attempting to post prohibited content: $4 per violation, or the applicable paid-posting price for paid sections if paid placement exists.
- Sending unauthorized email to an address obtained through Junior Bay: $25 per email.
- Sending unauthorized texts, calls, or other communications using Junior Bay user information: $500 per communication.
- Creating or using misleading contact information, identities, or posting credentials: $4 per violation.
- Abusing reporting, flagging, review, or moderation systems: $1 per violation.
- Distributing software or tools designed to violate these Terms: $1,000 per violation.
- Copying, aggregating, displaying, framing, distributing, licensing, selling, or exploiting Junior Bay content without permission: $3,000 for each day of violation.
- Requesting, viewing, or accessing more than 1,000 Junior Bay pages in any 24-hour period without permission: $0.25 per page after the first 1,000 pages.
- Bypassing or attempting to bypass moderation, access controls, rate limits, or security controls: $4 per violation.
These amounts do not limit any other remedy available to Junior Bay. Repeated or serious violations may cause irreparable harm and may entitle Junior Bay to injunctive or equitable relief in addition to money damages.
14. Disclaimers
To the fullest extent permitted by law, the Poster Board is provided on an "AS IS" and "AS AVAILABLE" basis. Junior Bay and its officers, directors, employees, contractors, agents, affiliates, licensors, service providers, and successors (the "Junior Bay Entities") make no promises, warranties, or representations about the Poster Board, including completeness, accuracy, availability, timeliness, security, reliability, quality, legality, fitness for a particular purpose, merchantability, non-infringement, or course of dealing.
Junior Bay does not guarantee any post, user, buyer, seller, employer, applicant, service provider, product, service, job, payment, delivery, appointment, meeting, review, rating, link, external feed, affiliate offer, or third-party website.
15. Limitation of Liability
To the fullest extent permitted by law, the Junior Bay Entities will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, personal injury, property damage, or the acts or omissions of users or third parties.
To the fullest extent permitted by law, the total liability of the Junior Bay Entities for all claims arising from or related to the Poster Board or these Terms will not exceed the greater of $100 or the amount you paid Junior Bay for the Poster Board in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
16. Indemnity
You agree to defend, indemnify, and hold harmless the Junior Bay Entities from and against claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Poster Board, your User Content, your posts, your off-platform interactions, your violation of these Terms, your violation of law, or your violation of another person's rights.
17. Governing Law and Venue
These Terms and any claim or dispute arising from or related to Junior Bay are governed by the internal laws of the State of Wyoming, without regard to conflict-of-law rules, except to the extent U.S. federal law applies.
Any claim or dispute will be resolved exclusively in the state or federal courts located in or serving Cheyenne, Wyoming, except that Junior Bay may seek temporary, preliminary, or injunctive relief in any court with jurisdiction. You consent to personal jurisdiction and venue in those courts.
18. Changes to the Poster Board or Terms
Junior Bay may modify, suspend, discontinue, or restrict any part of the Poster Board at any time. We may update these Terms from time to time. The updated date above indicates the latest version.
Your continued use of the Poster Board after updated Terms are posted means you accept the updated Terms. If you do not agree, you must stop using the Poster Board.
19. Miscellaneous
These Terms, together with any additional terms or policies referenced by Junior Bay, are the entire agreement between you and Junior Bay regarding the Poster Board unless you have a separate written agreement signed or electronically accepted by Junior Bay.
If any part of these Terms is found unenforceable, that part will be limited or modified to the minimum extent necessary, and the remaining terms will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Junior Bay may assign these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, or by operation of law.
